TERMS OF BUSINESS
REGULATION. Morgan Brokers Ltd, 41 Gay Street, Bath BA1 2NT is authorised and regulated by the Financial Services Authority. We are permitted to advise on, arrange, deal as an agent of insurers and assist in with the administration of non investment insurance. Our FSA Register number is 309466. You can check this on the FSA’s register by visiting the FSA’s website www.fsa.gov.uk/register or by contacting the FSA on 0845 606 1234.

OUR SERVICES. We are an independent intermediary (broker) acting on your behalf. Our service includes advising you on your insurance needs, arranging cover with insurers to meet your requirements and assisting you with the administration of, and, if necessary, alterations to the insurance we have arranged on your behalf. We offer products from a wide range of insurers but for some products we represent only one company. Please ask if you would like a list of the insurers we place business with. You can use this information to decide if our services are right for you.

CHARGES. We do not normally charge fees for arranging, amending, renewing or cancelling any policy of insurance. If we do charge fees for any policies we arrange for you, we will tell you in advance.

DOCUMENTS. We reserve the right to retain certificates or other policy documents until payments due under the policy have been made. Facilities may be available for payment of premiums by instalments. Full details will be given when we discuss your insurance. If instalment facilities are used we may retain documents until we have received acceptance and/or payment from the finance provider. Where we retain documents we will provide details of your insurance cover.

PREMIUMS. We hold premiums and premium refunds, but not claim monies, in a statutory trust account as agent of the insurer. We reserve the right to retain any interest earned on this account. When we do not act as agent of the insurer we will inform you and may ask you to make payment direct to the insurer or their agent.

LAW TO BE APPLIED
. Unless specifically agreed to the contrary, all contracts arranged through our agency are subject to the Law of England and Wales.
CANCELLATION. You may have a statutory right to cancel the insurance within a short period. Please refer to your policy summary or your policy document for further details. If your policy is eligible you will receive a pro rata refund of premium from the insurer. If you cancel outside this short period you may not receive a pro rata refund of premium. In both cases we may also keep an amount that reflects our administrative costs of arranging and cancelling the insurance.

CLAIMS. Please refer to your policy summary or your policy document for contact details if you need to notify a claim. You should contact us or the insurer direct as soon as possible or you may invalidate your claim.

YOUR OBLIGATIONS. Your insurance is based on the information provided by you to the insurance company and you must ensure that all such information is complete and accurate, and that all facts that may influence the insurers’ decision to accept your proposal and pay a valid claim are disclosed as soon as you become aware of them. Failure to disclose material information may invalidate your insurance and could mean that part or all of your claim may not be paid. When you receive your policy you are advised to read it carefully as it is the policy document, schedule and any certificate of insurance that is the basis of the insurance contract you have purchased. Please ask our advice if you are in any doubt over any of the terms and conditions of the insurance. Where your insurance includes Employers Liability cover you are required to retain your certificate for 40 years.

DATA PROTECTION. We are registered under the Data Protection Act 1998 and we undertake to comply with the Act in all our dealings with you. Your personal information will be kept secure. Please be aware that we exchange information with other insurers through various databases in order to speed up the processing of your data. You should also be aware that Insurers supply details of policies and claims to databases to which the Police, Fraud Prevention Agencies and other Insurers have access. You have a right of access to your own personal data held by us. You must apply to us in writing for such information
